Acceptance By purchasing products from the Site, you agree to be bound by and accept this Agreement. Orders are not binding upon BK Specialty Foods until accepted by BK Specialty Foods. BK Specialty Foods will indicate its acceptance of an order by acknowledging your order by reply email or by shipping to you the ordered items. Pricing Because prices, product descriptions and availability can change quickly, BK Specialty Foods does not warrant the accuracy or completeness of the information provided on the Site. Payment Terms; Orders The only payment method available for internet orders at this time is credit card. We accept VISA, MasterCard, American Express, or Discover. Cash, money orders, or personal checks are not payment options that we accept at this time. Shipping Policy Orders must be placed by 2:00 PM Eastern Time to be processed the same day. Most orders placed by that cutoff time will be shipped the next day. Orders placed on Saturdays, Sundays, or holidays will be processed the next business day. Some circumstances may prevent an order from being processed on the same day. All orders ship via UPS Ground delivery by default. This can take anywhere from 2-9 business days delivery time, depending on where you live. We do not ship outside of the continental US at this time. Orders under one pound are expedited by first class mail. We ship all orders as soon as possible. To protect our customers from potential credit card fraud, orders may be held for verification, this may cause a slight delay in shipping products to you. Shipping Charges; Taxes Separate charges for shipping and handling will be shown on your order form. Some orders may be held for credit card verification. This may cause a slight delay in shipping your order to you. We reserve the right to make partial shipments, which will not relieve you of your obligation to pay for the remaining deliveries if you request us to fill the backorder. If applicable, a separate charge for taxes will be shown on the invoice. Damages/Returns BK Specialty Foods is not responsible for damages that occur in transit. We inspect each item prior to shipment to ensure that the product you receive leaves our facility in good condition. If you receive a damaged item, contact UPS™ to report a claim. BK Specialty Foods will not reimburse you for the cost of products damaged in transit. UPS™ insurance is available at an additional cost of .35 per $100.00 of value purchased. If you are unsatisfied with a product you have purchased from BK Specialty Foods, you may return the unopened product for credit. Contact our Customer Service department at 1-800-354-9445 to obtain a return authorization number. Delivery and return shipping charges will be your responsibility and will not be reimbursed by BK Specialty Foods. Opened containers or partial cases will not be accepted and will not be eligible for credit. Minimum Orders There is no minimum order at BK Specialty Foods. Every order is as important to us as it is to you. Trademarks, etc. All brand names are registered trademarks of their respective owners. BK Specialty Foods does not claim any legal interest in trademarks, logos, or other intellectual property, than that of its own. Indemnity You agree to indemnify and hold BK Specialty Foods its partners and employees, harmless from any loss, liability, claim or demand, costs or expenses of any kind, including attorney's fees and/or other fees or expenses, made by any third party due to or arising out of your use of this Site.
